President Trump agreed on September 13 to about 80% of the ethics restrictions Senate Democrats had demanded on thecrypto Clarity Act, andXRP(CRYPTO:XRP) rose 3.9% to $1.39 over 24 hours.Bitcoin(CRYPTO:BTC) climbed 1.3% across the same window, so XRP moved three times as hard on a bill that would settle its legal status in federal law rather than a regulator’s interpretation.

Trump dropped what the White House had refused for months, and Senate Republicans released a 635-page final text the same night. The Senate votes September 15, 2026 at 2:15 pm ET. So does XRP’s rally hold once traders read the two gaps the concession left open?

What Trump Gave Up

Three senior Republicans and a senior Republican aide confirmed the deal. The clause Trump gave up lets state attorneys general enforce the bill, and the White House had held out against it for months.

State attorneys general can now bring civil suits alongside the Justice Department, and they can sue exchanges that list assets barred under the bill. That is a second enforcement track running in parallel to federal prosecutors, and it operates in 50 courtrooms rather than one.

Beyond enforcement, the final text forces officials, judges and their spouses to divest significant crypto holdings or place them in a blind trust, and bars them from issuing or sponsoring digital assets while in office. Trump’s own 2025 disclosure tied him to crypto-related income of $1.4 billion to $2.2 billion, which is the largest holding the rule would reach.

All of it arrived inside a 635-page text released by Senators Cynthia Lummis, John Boozman and Tim Scott, carrying 126 substantive changes requested by Democrats. One of them is a stablecoin yield circuit breaker, meaning a switch regulators can flip to intervene if deposits move sharply out of community banks and into yield-bearing stablecoins. The clause insures against a bank run and leaves the product untouched.

Why XRP Rose 3.9% and Bitcoin Only 1.3%

Bitcoin’s 1.3% put it in line withEthereum(CRYPTO:ETH) at 1.0% andSolana(CRYPTO:SOL) at 1.5%, so XRP beat all three by more than double. XRP holds its commodity classification through a joint SEC and CFTC interpretation from March 17, and regulators can withdraw an interpretation whenever they choose. The Clarity Act would write the classification into statute, and the Senate text namesXRP and XLM as digital commodity examples.

Bitcoin and Ethereum have very little to gain from a bill that codifies what spot ETFs and settled case law already gave them, so their moves read as a market-wide risk-on tick rather than a status change.

Polymarket priced the shift the same way, moving from 18% to 21.5% on the bill becoming law in 2026. XRP has reclaimed its200-day moving average of $1.355and trades 1.4% below the $1.40 to $1.41 resistance band. The 200-day average is the rolling mean of the last 200 daily closes, which traders read as the boundary between an uptrend and a downtrend.

The funding rate reads negative 0.0094%, the most negative since June 28, so derivatives traders have bet against the move by paying long holders every eight hours to keep their shorts open. A pass on Tuesday would force those shorts to close by buying XRP at the market, which is how a squeeze starts.

Gaps the Concession Left Open

The text doesn’t cover an official’s children. World Liberty Financial is run by Trump’s sons, so the divestment and blind trust rules stop at the spouse. A president who has to divest still has adult children who don’t.

The restrictions expire in January 2029, as the next presidential term begins. An ethics rule that switches off the day the next administration is sworn in gives Democrats a second problem, because a Senate that passes the bill with 60 votes has no leverage to renew the rules in 2029. Whoever wins the 2028 election inherits a Clarity Act whose ethics provisions have already lapsed.

Kirsten Gillibrand, Ruben Gallego and Angela Alsobrooks are the named Democratic negotiators, and none of the three has publicly confirmed support. Senator Lummis said in her release: “President Trump voluntarily agreed to unprecedented ethics restrictions… Democrats got what they wanted; now they need to take yes for an answer.” The bill needs 60 votes to clear cloture, and thecount going into Tuesdayhas not moved with the text.

Does XRP’s Rally Survive Tuesday?

XRP repriced three times harder than Bitcoin because XRP is the coin whose legal status the bill settles in statute, and that part of the move rests on something already in the text. The harder question is whether 80% of the ethics package pulls enough Democrats across, and the two gaps the concession left open, the children and the January 2029 expiry, are the objections Gillibrand, Gallego and Alsobrooks have not withdrawn.

If one of the three commits before Tuesday, XRP’s move survives and the $1.40 to $1.41 band gives way. If none do and cloture fails, the funding rate flips positive as the shorts win the trade, and XRP loses the $1.355 average it reclaimed on the concession headline. Either way, the answer arrives inside 36 hours.
