Senate Democrats huddle tonight to decide whether nine of them will give Republicans the votes needed just to start debating crypto’s biggest regulatory overhaul in years, and neither side has shown its hand yet.

The Senate votes on cloture on the motion to proceed to H.R. 3633 at 2:15pm ET on Tuesday, September 15, 2026. Cloture ends a filibuster and lets the chamber start debating a bill, and it takes 60 votes. Republicans hold 53 seats, at least two are expected to vote no, and that leaves the majority nine Democrats or independents short.
Senate Democratic leader Chuck Schumer is convening his caucus on the evening of September 13. President Trump met his advisers on September 11 to work through the ethics language, and no revised text has circulated since. So do the Democrats have nine yes votes in the room?
The CLARITY Act Needs 60 Senators Just to Start Debate
Tuesday’s cloture is on the motion to proceed, which is the question of whether theSenatetakes the bill up at all. It is not a vote on H.R. 3633, and it is not a vote on the substitute text. Debate on the text begins only after the chamber agrees to proceed, and amendments come after that.
A clean party-line yes would still need seven Democrats or independents, and the two Republican no votes are a whip estimate rather than a confirmed count. About a dozen Democrats have negotiated on the bill for months, and not enough of them have publicly committed to guarantee the 60 votes.

Both readings cover a signed law by year end rather than Tuesday’s procedural step, so cloture can clear and the bill can still die on the House calendar or the ethics fight.
Democrats Want the Trump Crypto Ethics Rule Tightened
The current draft bars officials and their spouses from issuing or sponsoring digital assets while in office, permits personal holdings, and expires in 2029. Democrats want it stronger, aimed at the Trump family’s World Liberty Financial holdings. A bipartisan counterproposal circulated in late July and drew no White House response for several weeks.
White House crypto adviser Patrick Witt posted on September 12 that it was a “Bad day to be a Clarity Act doomer” and that the administration had “already accepted an ethics provision,” without saying which one. Illicit finance and anti-money-laundering requirements are unresolved alongside ethics, the Senate Agriculture Committee text has not been folded in, and stablecoin rewards and yield are unsettled.
The Senate substitute released on September 10 runs 630 pages and added 114 Democratic provisions. Certain non-decentralized trading protocols must register with the CFTC, DeFi rules were narrowed to spot and cash digital commodity transactions, and credit unions received clearer authority. The National Sheriffs’ Association moved from opposition to neutral, which removed a law-enforcement objection Democrats had cited.
XRP Keeps Its Commodity Status Either Way
The SEC and CFTC classified the coin as a digital commodity in ajoint interpretationon March 17, and regulators can withdraw an interpretation whenever they choose. CLARITY would write the same classification into statute, so Tuesday sets how durable XRP’s (CRYPTO:XRP) status is rather than whether XRP has one. XRP trades at $1.35, up 4.5% over the past week and 36.7% over the past month.
If cloture clears and the bill later passes both chambers, the commodity treatment becomes law and the boundary between SEC and CFTC authority stops depending on who runs either agency. If cloture fails, oversight stays with agency rulemaking through at least 2029, and Senator Cynthia Lummis, who is retiring, has warned that no CLARITY now means 2030.
The House has cut two voting weeks from its calendar, so floor time after cloture is tight even if Tuesday clears. A yes vote would also set up a passage headline the market haspartly priced already, and the Federal Open Market Committee announces its rate decision at 2pm ET the following afternoon.
Nine Democrats Hold the Vote
Tuesday turns on whether nine Democrats accept the Republican offer to proceed now and negotiate ethics on the floor rather than before it. Neither Schumer’s caucus meeting nor Trump’s session with his advisers has produced a public readout, so the count going into Tuesday is the one that stood on Friday.
Revised ethics text circulating in writing on Monday would probably grow the yes column past nine, and a public commitment from the negotiating bloc would likely settle it. If neither happens by Monday evening, the count stays where it is, cloture probably fails, and XRP carries an agency interpretation into the Fed decision on Wednesday afternoon.
