The US Senate’s Sept. 15 procedural vote may be the last chance to pass the CLARITY Act for years, White House crypto adviser Patrick Witt said, warning that a failed vote would leave the crypto market structure bill with no clear route back to the floor.
Witt, executive director of the US President’s Council of Advisers on Digital Assets, spoke to Semafor in an interview posted Thursday. “I’m optimistic about Sept. 15,” he said.
The CLARITY Act would set which tokens count as securities and which as commodities, the first comprehensive US federal framework for the industry. It passed the House 294-134 in July 2025 and now needs 60 votes in the Senate.
Witt put Republican support for the motion to proceed at or near all 53 GOP senators, and urged Democrats to vote to open debate even if they oppose the bill as written. “Your concerns about ethics will not be addressed if this bill fails,” he said.
The provision already in the bill bars all federal officials from issuing or sponsoring digital assets. How much further it should go in terms of the president was left unresolved in the revised text Senate Republicans released on Thursday, a day after US Treasury Secretary Scott Bessent made his own appeal to the Senate.
Witt said it was “entirely possible” that the ethics provision already in the bill is the one senators are asked to vote on, with President Donald Trump “the ultimate decider” on any change.
SEC and CFTC Will Write Rules If CLARITY Act Fails
If the bill dies, Witt said, the administration will fall back on the regulators. “We’ll lick our wounds very quickly, and we’ll turn to the next chapter, which is an aggressive rulemaking agenda at both agencies,” he said.
He cited a coming innovation exemption at the US Securities and Exchange Commission and planned actions at the Commodity Futures Trading Commission. “So either way, there’s clarity coming in a sense.”
When it was brought up that US Senator Cynthia Lummis has warned failure could push market structure legislation to 2030, Witt said: “I don’t know if I would put a specific date on it.” He instead connected the timing to the November midterms and the 2028 presidential election.
Traders on prediction market Polymarket priced the bill being signed into law in 2026 at 18% at the time of writing, up from about 15% a week ago.
