The SEC announced on Tuesday that it had filed a proposal titled “Regulation Crypto Assets”, giving crypto entrepreneurs a clearer, considerably lighter route to raising capital under federal securities law, according to the press release published by the regulator.

The U.S. Securities and Exchange Commission (SEC) has proposed a new framework for certain crypto assets, giving digital asset companies a potential path to raise capital without automatically having their tokens treated as investment contracts.

The SEC proposed specialized exemptions for certain crypto investment contracts, including a pathway for offerings reaching $75 million annually. The plan also introduces a conditional safe harbor and federal disclosure requirements.

The proposal pairs two registration exemptions with a conditional safe harbor that would take the “investment contract” label off a token, and preempts state securities law. All three sitting commissioners backed it in a vote held outside a public meeting. By:The Defiant Team• Regulation & Politics
