The U.S. Commodity Futures Trading Commission is pursuing a rule that would place event contracts traded on prediction markets such as Polymarket and Kalshi under the category of financial derivatives known as swaps. According to a document from the Office of Information and Regulatory Affairs, the CFTC submitted a proposed rule that would redefine event contracts, excluding casino-style gambling, as swaps.
If event contracts are formally classified as swaps, the CFTC would hold exclusive regulatory authority under federal law. Amid ongoing opposition from state gambling regulators seeking to classify sports and political prediction contracts as gambling, the measure would put the CFTC in a stronger position in the jurisdictional battle over federal oversight of prediction markets in the U.S.
