    The crypto market is approaching one of its biggest regulatory tests of 2026 as the U.S. Senate prepares for a September 15 procedural vote on the CLARITY Act.

    The bill needs 60 votes to clear the cloture hurdle and move forward. It is not the final passage vote, but success could create significant momentum for the legislation.

    Washington is still divided over the bill’s prospects. Some industry observers believe the legislation is close to moving forward, while others have warned that it could fail to secure enough support.

    That uncertainty is now becoming part of the market story.

    Is the CLARITY Act Really in Trouble?

    Former federal prosecutor Renato Mariotti has argued that the bill is effectively dead based on conversations with lawmakers and congressional staff.

    Coinbase Chief Policy Officer Faryar Shirzad has offered a more optimistic view, saying he remains encouraged by the bipartisan negotiations and believes there is a path to 60 votes.

    Ripple Chief Legal Officer Stuart Alderoty has also described September 15 as a critical test, noting that the procedural vote requires 60 senators to support moving the bill forward.

    The legislation has continued to evolve. Senate Republicans released a revised 630-page version on September 10 that incorporated more than 114 provisions requested by Democrats, including new rules covering certain non-decentralized finance protocols.

    The latest developments suggest the bill remains alive, although its final outcome is still uncertain.

    Why 60 Votes Matter

    The September 15 vote is a procedural vote, not a final vote on the CLARITY Act.

    If the bill reaches 60 votes, the Senate can proceed with debate and amendments. That would significantly improve its chances of eventually reaching final passage.

    If it fails to reach the threshold, negotiations could continue, but the legislation could also stall.

    The distinction matters for crypto investors. A successful procedural vote would not immediately create new regulatory rules, but it could remove one of the biggest obstacles facing the bill.

    What CLARITY Could Mean for Bitcoin, Ethereum and XRP

    The CLARITY Act aims to establish clearer boundaries between the SEC and CFTC and create a more defined framework for digital assets.

    For Bitcoin, the impact would primarily come through clearer CFTC oversight of digital commodity markets and trading platforms.

    Ethereum could benefit from a clearer path for assets that begin under securities regulation but later qualify for commodity treatment as networks become sufficiently decentralized.

    For XRP, regulatory clarity could be particularly significant because the token has already been at the center of a long-running SEC dispute. A defined framework could reduce some of the uncertainty surrounding its future classification.

    The bill would not instantly change the status of every token. Instead, it would establish a broader legal framework for determining how different digital assets are regulated.

    Could Bitcoin Rally if the Bill Advances?

    A positive Senate vote could improve sentiment across the crypto market.

    Crypto analyst Tony has pointed to a bullish divergence forming on Bitcoin’s chart alongside weakness in stablecoin dominance. In his view, these signals suggest the market may be consolidating rather than entering a deeper bear phase.

    He has also rejected forecasts based on the four-year cycle that call for Bitcoin to fall toward $30,000 – $40,000 in October, arguing that current technical conditions do not support such a scenario.

    Still, the CLARITY Act would be only one market catalyst. Monetary policy, ETF flows, liquidity and broader risk sentiment could determine whether any regulatory rally lasts.

    XRP Could See the Biggest Regulatory Reaction

    Among major cryptocurrencies, XRP could be especially sensitive to the outcome.

    The token’s regulatory history makes clarity particularly valuable for investors and institutions. A successful vote could reduce some of the legal uncertainty that has surrounded XRP and potentially improve sentiment toward the asset.

    That does not guarantee a price surge.

    The market could also price in the outcome before the vote, creating a classic buy-the-rumor, sell-the-news reaction if the legislation advances.

    Recent XRP weakness has already reflected the uncertainty surrounding the vote, making September 15 an important short-term catalyst.

    What Happens if CLARITY Fails?

    A failed procedural vote would not make crypto unregulated.

    Existing securities, commodities and financial laws would continue to apply, while the SEC, CFTC, courts and individual states would retain their existing powers.

    The bigger issue would be continued uncertainty.

    Crypto companies could face years of regulatory disputes before clear legal boundaries emerge. Industry groups have argued that this uncertainty could encourage companies, jobs and capital to move outside the United States.

    The global impact could also be significant. A successful U.S. framework could become a model for other countries developing their own digital-asset regulations.

    The Week Could Be Bigger Than the CLARITY Vote

    The Senate vote comes on September 15, followed by the Federal Reserve’s policy decision on September 16.

    That creates a particularly important 24-hour period for crypto markets.

    A successful CLARITY vote combined with a less aggressive Fed could provide a powerful boost to Bitcoin and major altcoins. Conversely, a failed vote alongside hawkish monetary policy could increase pressure on risk assets.

    For now, the outcome remains uncertain.

    Bitcoin, Ethereum and XRP are effectively waiting for Washington to decide whether months of negotiations can finally produce enough votes to move U.S. crypto regulation forward.
